The ones on eBay are second Hand. I have seen Gen 2 Smart modems as low as $30 still in there boxes with all accessories for $30 and Gen 1.1 Smart modems for $9 at cash convertors.
They might be in new condition in there original box but they are not new. Telstra does not sell it modems on ebay.

This is perfectly legal. There are no laws forcing all sealers to sell goods at the same price, or stopping sellers from even selling goods at a loose.
The sim number for the 4G fall-back is matched to the customer internet service. Also modem serial numbers are matched.
Modem serial numbers aren't service matched (4G SIM - yes). That was only for Cable modems.
The smart modems can be used anywhere (even on a non-Telstra service).

Even the 4G SIM isn't matched to a customer until the modem is connected to a Telstra service. The 4G SIM is then recorded against the customers service. If modem is transferred to a another Telstra customer the 4G SIM is automatically recorded against the new customers service when modem is connected to there fixed line Telstra service.
Hopefully then when I break my Telstra contract and have to pay out the modem I’ll be able to sell it on eBay to get some money back but my guess is it won’t be worth much.
