Third party charges

My account this month has a $5 third party charge but I have no sms or phone contact in my log regarding anything on the date they allege it occurred and know nothing about this. In reading up I believe these charges are now illegal due to the $10 million dollar fine earlier in the year is this right and if so how did I get charged $5 I have contacted Telstra who have barred all future charges but seem unable thus far to get a revised bill issued?
