I think, considering I've raised a rather in depth look at the terms and conditions, they are reluctant to make a statement until they check with their lawyers (don't forget, moderators here are customer service, and with all respect shouldn't be required to interpret the customer terms in the above fashion.

I would contact Telstra via their complaints page - www.telstra.com.au/complaints - and feel free to use parts of my argument above when discussing it. Don't be surprised if its referred to a case manager and it takes a bit longer, your challenging the interpretation of a legal document.
